JOB DETAILS:
1.0. INTRODUCTION AND BACKGROUND
In December 2020, Diakonia and Caritas Zambia/Christian Churches Monitoring Group are implementing a project whose aim is to contribute towards Enhancement of the Credibility and Acceptance of the 2021 General Election Results in Zambia. Diakonia is a joint development organization of the Uniting Church in Sweden and the Swedish Alliance Mission. The organisation has been in existence since 1966 with the head office located in Sweden. Diakonia has regional offices in Africa, Asia, the Middle East/North Africa and Latin America, as well as local offices in most of the 28 countries where Diakonia has partner organisations. Diakonia’s mission and overall goal is to change unfair structures – political, economic, social and cultural – that generate poverty and inequality, as well as oppression and violence. Diakonia works with individuals, local partner organizations and other actors to fulfil the right to a life of dignity for all people, regardless of their age, class, disability, ethnicity, gender, nationality, political conviction, religion or sexual orientation and identity. In Zambia, the organisation has been operational since 2003 working with various Civil Society Organisations in the areas of Democracy, Human Rights and Gender Justice.

Caritas Zambia is a Faith Based Organization which serves as one of the seven departments of the Catholic Secretariat in Zambia. The Catholic Secretariat is a mechanism that supports the work of the Zambia Conference of Catholic Bishops (ZCCB), formally Zambia Episcopal Conference (ZEC). Caritas Zambia hosts the Christian Churches Monitoring Group (CCMG). CCMG is a consortium of four faith-based organisations(Zambia Conference of Catholic Bishops- ZCCB through Caritas Zambia (co-applicant), Council of Churches in Zambia- CCZ, Jesuit Centre for Theological Reflection- JCTR and Evangelical Fellowship of Zambia- EFZ), through which the elections project will be implemented.
This elections project seeks to contribute to promoting transparency and accountability of the electoral and political processes as well as the integrity of the 2021 elections in Zambia. With the overall objective of enhancing the credibility and acceptance of election results, the project will mobilize and capacity build election monitors (men, women and youths) to monitor various electoral processes, mobilize and facilitate dialogue around the 2021 general elections, monitor elections and publicise election information and PVT results.
2.0. Purpose and objective(s) of the Electoral Legal Framework Review
The main objective of the Electoral Legal Framework review is to provide an understanding of the current legal framework governing elections in Zambia and how they promote holding of democratic, transparent credible and inclusive elections. Specifically the legal review should attempt to:
i. Identify all legislation governing elections in Zambia
ii. Review such legislation to identify gaps or barriers that limit the holding of democratic elections
iii. Review legislation in relation to constitutional provisions and how such legislation limits or promotes holding of democratic elections
iv. Map out key stakeholders/institutions for reform and engagements .

3.0 SCOPE OF WORK
The Consultant is expected to carry out the following;
a. Conduct a review of the Constitutional Amendment No 2 of 2016 in relation to promoting holding of democratic elections, establishment of key institutions dealing with elections and establishment of key electoral process activities
b. Review the Electoral Process Act No 35 2016 (including the SI 80 of 2020, and Electoral Process Amendment Bill of 2021, the Electoral Act 2006, and all other electoral legislation) in relation to promoting, holding of democratic elections and establishment of key electoral process activities, the role of the media in elections and the electoral process
c. Review the Cyber Crimes and Cyber Security Act and its implication in relation to how it limits or promotes holding of democratic, transparent, credible and inclusive elections
d. Review the Public Order Act and its implication in relation to how it limits or promotes holding of democratic, transparent, credible and inclusive elections
e. Review media regulation with particular regard to the new media bill, media coverage and equal access, including the IBA and relevant Electoral Code of Conduct provisions.
f. Review specifically the 2011 Sarah Brotherton Vs Attorney General and the ECZ, to look specifically at the implementation (or lack thereof) of the Judgement Review of the electoral rights of persons with disabilities.
g. Review international and regional instruments governing the holding of democratic elections in general and make specific reference to the Zambian context
h. Make recommendations targeted at key actors/institution/stakeholders for purposes of legal and institutional reform
i. Produce an 8-10 page Electoral Legal Framework Review Report


QUALIFICATIONS
1. The candidate must be of a legal background and registered with the Law Association of Zambia,
2. Must have knowledge of drafting laws,
3. Knowledgeable on democracy and good governance as they relate to constitutionalism and the electoral process
4. Deep understanding of elections, the electoral process, governance and political landscape in Zambia and the region will be an added advantage.
5. Practicing certificate would be an added advantage


4.0 OUTPUTS/DELIVERABLES
The outputs should include the following;
1. Submit an 8-10 page Report on the Review of the Electoral Legal Framework
2. Make necessary recommendations for Constitutional and Electoral reform as the opinion may suggest
3. Facilitate two (2) review meetings and suggest key stakeholders relevant to the process
5.0 TIMEFRAME
This consultancy is for a period of Twenty (20) days including two (2) days for review of the report

The Technical Proposal should have detailed a methodology including the following:
i. Objectives and understanding of the scope of the assignment;
ii. Description of the methodology and tools to be used and developed for the assignment;
iii. Time framework.
iv. Detailed financial proposal.
