TENDER NO. RDA/ PPP/CP/003/2022: The Government of the Republic of Zambia ("GRZ" or "Government") in its endeavour to attract private investment in infrastructure development has identified the Katete to Chanida road as one of the roads requiring development. The Katete to Chanida road covers a total distance of 55km starting at the junction with the T4 at Katete and ending at the border post of Chanida. The road connects Zambia with Mozambique and is a strategic corridor that provides a crucial link to the Port of Beira. It provides for the export of copper and other minerals from the Democratic Republic of Congo (DRC) and Zambia. The current condition of the road is however in poor state and poses a deterrent to intra-regional trade. It is thus a vital and strategic part of the core road network in Zambia that requires development.

In order to develop road infrastructure in the country, the Government created the Road Development Agency (RDA) through the Public Roads Act No. 12 of 2002 to provide for the care, maintenance and construction of public roads in Zambia. Furthermore, through the Tolls Act No.14 of 2011, the GRZ authorized the RDA to operate toll roads and collect tolls. The Tolls Act also provides for private sector participation in the tolling of roads. The RDA is mandated to: (a) regulate the operation and maintenance of toll roads; (b) monitor compliance of concessionaires with the terms and conditions of concession agreements; (c) advise the Minister on the design, construction, safety, regulation, operation and maintenance of toll roads; and (d) perform such other function as may be conferred by, or under, the Road and Tolls Act or any other law.

This notice serves to notify the general public that the Road Development Agency received an unsolicited proposal for the "Finance, Design, Build Operate and Transfer of 55km of the Katete to Chanida Road and Border Infrastructure on a Public-Private Partnership (PPP) Basis" under a Public-Private Partnership (PPP) arrangement.

The general nature of the unsolicited proposal identifies the possibility of Finance, Design, Build Operate and Transfer of 55km of the Katete to Chanida Road and Border Infrastructure on a Public-Private Partnership (PPP) Basis arrangement. Therefore, Government through the RDA intends to enter into a PPP agreement to undertake the aforementioned project. The procurement process for selection of a private entity shall be conducted in accordance with the PPP Act No. 14 of 2009 as amended.

The Road Development Agency now invites interested local and international private sector entities to submit Financial and Technical competing proposals pursuant to sub- section 42 (6) of the PPP Act No.14 of 2009 as amended. Bidders shall demonstrate technical capabilities, financial, legal, economic proficiency and commercial capacity to finance or to secure financing for the investment required under such a project. RDA shall evaluate the unsolicited proposal and any comparable competing proposal using the following criteria:

(a) novel methods, approaches or concepts demonstrated by the proposal; (b) scientific, technical, or socio-economic merits of the proposal;

(e) potential contribution of the proposal to the contracting authority's mission; (d) capabilities, related experience, facilities, or techniques of the private entity or unique combinations of these qualities that are integral factors for achieving the proposal objectives;

(e) qualifications, capabilities, and experience of the proposed team leader or key personnel, who are critical to achieving the proposal objectives;

(1) how the proposal benefits the public; and

(g) any other factors appropriate to a particular proposal.

Eligibility criteria, establishment of the successful bidder and the selection procedure shall be in accordance with Public Private Partnership Act No.14 of 2009 as amended and the issued Request for Competing Proposals (RCP). Interested parties may obtain further information on the RDA website or at the address below during office hours from Monday to Friday, 09:00 hours to 16:00 hours. Eligible bidders may inspect and/or purchase the RCP document from the Road Development Agency Head Office at a non-refundable fee of US$25,000.00 in cash or bank certified cheque or bank transfer, and the bank details are as follows
